What happens if a landlord servers a 5 day notice for the wrong amount?
Would a tenant still be liable to pay the landlords court cost and lawyer fees, if the tenant pays the correct amount and all late fees before the court date, and proves to the court that the landlord 5 day notice is incorrect.

Call and talk to the landlord and discuss the error. S/he should correct the invoice. The fact that the invoice is in error does not change the fact that you were served with the 5 day notice and that you owe the rent and the late fee.

So talk to the landlord, get the correct amount and pay it before he goes to court. Once he goes to court you will have to pay the court fees.

Read the tenant rights and responsibilities booklet, and your lease agreement.
