I have looked everywhere on the internet (in laws, codes, etc.) but I still cannot find and answer, so I'm posting here.
My friend recently signed a lease in Philadelphia that does not allow sublets. The lease is split between three people (two bedrooms because two are a couple), but one of them cannot move in until the fall.
Until then, the my friend and one other person on the lease are splitting the rent 50/50.
My friend wants to let another friend stay (sleep on a cot in a shared space) for a month until she can move in to her new apartment.
She is interested in having the friend split the rent with her. Is this legal? Is this a sublet?
Who's to know? It's a friend staying temporarily, not a sublet agreement. Not something I would lose sleep over and if the LL says anything (highly unlikely), it's just a friend staying temporarily and neither an occupant nor a subtenant. Just to be on the safe side make sure the stay IS only for a month and not longer.
