The homeowners association covenants in our condo complex prohibit renting. However, an owner in our building has been renting "under the table" for over four years. The owner's tenant moved 9 months ago and the place was on the market. It didn't sell and now the place is being rented again. Any advice on how to stop this owner from violating the rental prohibition?

You can fine him but unless you are having a problem with the tenant, I'd let it slide in this housing market. He may have HAD to move and could not sell, and it would either get foreclosed on or he had to rent it.

Housing market is bad bad bad...go easy on him.

I say cover the unit with dog poop and toilet paper. Hang some voodoo dolls from the entry door and place a chicken head on the doormat. (just an opinion).

Reporting them to the hoa is the obvious answer, but I was hoping someone has had experience with this problem and could give me an idea of what to expect.
As for letting them slide because of the market, no, because it was rented under the table for 4 years with no attempt to sell and only token efforts were made to sell it while it was tenantless the last 9 mos. There are plenty of people who can't sell here right now and would rather rent their units, not everyone has "friends" they can rent to and skirt the rules.

Why does the HOA have a 'no rent' rule? Maybe the rule should be re-addressed. Especially in the current market. So if I understand the HOA.. better to take a loss on your property than rent to a qualified person/family?

I tend to agree with you on this, but the problem would be that absentee owners would be deciding who is qualified. Also, it would be difficult to change rule because of high percentage of senior residents who would oppose it.

Not to be rude...but why do you care if it's being rented or not, if the renter is a respectable person? Better a good tenant than a vacant place, IMO. Although I see your point about not wanting just "anyone" to rent next to you. Tough choice.
