He needs to require one assistance with daily living like toileting, dressing, ambulating, bathing, meals or be unsafe left alone. Sometimes the VA reps aren't very knowledgable about how things should appear on the application and there are adjustments that can be made if you're over the asset limits. If your VA rep isn't familiar with the program, most larger in-home providers are. They make it their business to know all the ways they can get paid.
Ideally your local AAA (area agency on aging) should be able to give you the name of someone who can help you.
I have found, it is a great program for vets whose income and/or assets are just a little too high to qualify for Medicaid.
