I currently live in stl and in ch 13 bk just filed for unemployment benefits and i included the overpayment in my bk and wanted to know will i still receive my unemployment are will they take it from me i was told by someone that they have to give it to me cause im in bk and they are included does anyone know they did send me paperwork saying how much i will receive per week but it also said the overpayment need to be paid first?????
Chances are unless you notify your state yourself immediately about inclusion of the overpayment in your bankruptcy filing, you will NOT receive benefits until the overpayment is satisfied. Even then, they may ignore the bankruptcy. The UE offices are good at that. That said, some states don't allow forgiveness of UE overpayments in bankruptcy if you are filing under state law.
