The same thing happened to me but unfortunately altho I was recieving benefits they stop because of the phone examiner interpretation of my cases said I had severe misconduct due to infractions against me two years ago that I never was reprimanded for..my job just started a point program this year and goes back three years into the work history so I was let go because of driving infractions back in 2014/2015. Now im trying to see what are my odds to winning a appeal??
Battle21...Why did they bring about such a claim during your employment which happened a few years ago? Doesn't seem fair. I would appeal and tell them at the time it wasn't presented to you as misconduct and simply a work related mistake or one time problem which hopefully your conduct improved the years that followed up until they decided to let you go. You should at least be considered for unemployment re-instatement again...It wouldn't hurt to try and appeal.
Exactly Starfive thats what I was thinking..I feel as though since those occurences took place prior to the new point system that I should'nt have been charge for past offences but rather giving a clean slate along with all the other employees...smh I have appealed just waiting for my date...does anyone know how long that process take...I appealed on 10-17-16...??
NJ takes about 6 to 8 weeks for an appeal hearing after submission of the request.
UI is about the reason you lost your job at the time you lost it. Changing the point system and firing you over something that happened a year ago is NOT misconduct.
That's why you need to type in the decision. WHY did you get denied? You need to stay focused on what was written and not what you were told. You'll also be able to see the written response from your employer and the notes from the interviewer's phone call to the employer, and yourself.
Thanks Chyvan..but what is UI..im not familiar with this appeal process I already sent in my appeal via online...Im not sure what to expect during the hearing..and it was the claims examiner who denied me on the conclusion of severe misconduct states that i deliberately disobeyed comp policy eventhough i told her that policy was put in place after the occurences..im not sure what my employer said via notes sent in..im just ready for this nightmare to be over...smh
Since the appeal was submitted, you now wait for your hearing date and until you can get access to the hearing file or packet, and then come back, and we'll start to prepare you.
I have an appeal hearing this friday 11/4/16, im looking for any pointers that can help me present my argument....??
