My wife works a designer clothing store. She cannot keep her job if she cannot fit into the clothing provided. When the current season (uniform) arrives from Italy, each stylist is fitted and the clothing altered to fit. The clothing only comes in certain sizes meaning nothing larger than a 12. If the clothes don't fit you gotta quit.

Of course they do, and a pretty damned good one.

To the guy whose wife works in designer retail...I imagine that was a condition of the job when your wife was hired...not quite the same for the casino employees.

If the casino can prove the rebranding is vital to their ability to survive financially, they will win. In the same way, as Hooters can demand physical appearence be taken into account for continued employment.

When Resorts was purchased and under new management, it is theoretically no longer Resorts! The new management/ Company can fire and replace any and all employees at will from top to bottom. Cocktail servers in Atlantic City casinos are all in the union and once hired, can't be fired all that easily. Start up is something else altogether though!

You will notice that the Borgata, a relatively new casino has all incredibly hot-looking waitresses, the "Borgata Babes" as they are called. Stop by there in about 15 years and see what they are looking like! They will then look as war-torn and weatherbeaten as the cocktail waitresses at Caesars, some of which have been there for a LOOONNNNGGGG time.

The thing about why Borgata has such hot-looking waitresses is that they are a relatively brand new casino and the waitresses were carefully hand-picked. New ownership means essentially the same thing! If they fire much of the middle-management also (which they will and replace them as they see fit) will they have a leg to stand on if they sue? Of course not! There is no law that stipulates that when you buy a business you are contractually obligated to keep all the previous employees and it's your option to change staffing and management as you see fit.

They would be sueing a company that has folded and the company folding is the basis of them losing their jobs. Any waitressing staff that they keep are essentially "new hires".

Size 12 is not exactly petite. I'm a curvy 5'6" and wear a 6, an 8 in certain styles cut narrow through the hips or chest.
