HIPAA is very specific about what is a covered entity. A jerk of a boss is not one.
I'm not saying what he/she did is right, but please don't invoke HIPAA if you don't know what the law really says - you are spreading misinformation that, if blindly followed, could potentially hurt the employee's case.
