I still find it absolutely shocking that of all the windows on that ship Mr. Anello picks the one open window on which to let the child "bang on the glass." It just defies understanding, imo.

Well, OK, that's in a world where people spoke truth.
No jury trial for this, I don't think. Settlement, if any, will probably occur out of court.
Not so sure. They've been hinting at a lawsuit since July, I'd be extremely surprised if there hasn't been a few offers to make a settlement already. Looks like the cruise line didn't bite.
Did a child who herself could have fallen out manage to open the window?
Except such a thing has never happened because it would be nearly impossible for a child to fall out those windows. They are 4 feet above the deck, at chest level for most adults. How is a child going to open the window and then fall out?
The window being able to open is not relevant. Chloe did not die because the window was open. She died because her grandfather chose to pick her up and place her on a railing in front of an open window. She would have never fallen out that window if she had been on the ground.

I don't think big corporations usually make an offer to "settle" before a lawsuit is filed.
Unless the claim is going to be very small - an item the staff broke, a small injury, etc.
When they get served with the lawsuit is when the depositions and negotiations begin.
