I didn't say baby.

Attorney: The relevance is Mr. Normal is the responsible negligent party because he caused a hazard by opening the window and failing to predict a GrandPa could place his grand baby on a railing in front of said open window and then let go of her.

I didn't say one year old.

I said child.

It appears you think I was imagining it was Chloe who opened the window?

Reread, please.

They happen.

Half of that jury might think the man having this on his mind for life is enough punishment.

Also, who would design a window like that on a cruise ship?? Anyone could stumble and fall out. Lots of wasted people on cruises.
No jury trial for this, I don't think. Settlement, if any, will probably occur out of court.

I still find it absolutely shocking that of all the windows on that ship Mr. Anello picks the one open window on which to let the child "bang on the glass." It just defies understanding, imo.

Judge: Is Mr. Normal named as a defendant?

Attorney: Your Honor, with all due respect, is the Court kidding? He doesn't have a penny to his name. We're not going to sue someone without money, do we look like idiots?

Well, OK, that's in a world where people spoke truth.

Not so sure. They've been hinting at a lawsuit since July, I'd be extremely surprised if there hasn't been a few offers to make a settlement already. Looks like the cruise line didn't bite.

Except such a thing has never happened because it would be nearly impossible for a child to fall out those windows. They are 4 feet above the deck, at chest level for most adults. How is a child going to open the window and then fall out?

The window being able to open is not relevant. Chloe did not die because the window was open. She died because her grandfather chose to pick her up and place her on a railing in front of an open window. She would have never fallen out that window if she had been on the ground.

I don't think big corporations usually make an offer to "settle" before a lawsuit is filed.

Unless the claim is going to be very small - an item the staff broke, a small injury, etc.

When they get served with the lawsuit is when the depositions and negotiations begin.
