What I read is that there are more minorities in this jury than whites. I think there are only 2 white jurors.

Killing wasn't premeditated but it was unprovoked and reckless. This is textbook 2nd degree murder (I think in Texas they call 2nd degree murder just "murder").

If the jury has any cajones this is the rightful charge. Guarantee you 1 or 2 jury members will hold this up and she gets off easy with something along the lines of voluntary manslaughter (or whatever the Texas equivalent name of the charge is)

The jury is 5 black, 4 Latino, 2 white and 1 Asian.

Murder does not require premeditation in Texas. There's murder and capital murder. Capital murder would be punished with a life sentence or the death penalty. You might see this in a case where a guy goes on a killing spree or a woman murders her children.

Murder in TX just means that when you pulled out the weapon of choice, your intent at that moment was to kill. Guyger didn't wake up with the plan to Botham Jean....but when she pulled out her gun and aimed, it wasn't shoot to maim or hold him in place. She aimed directly for the heart. In that sense, murder actually makes the most sense as a charge.

Not saying anything but I can tell you that I've done the exact same thing she did. I got off on the wrong floor and entered the apartment directly below mine not paying attention. It honestly can happen!!


Either way: this whole situation is horrible for everyone involved.

I think we have made mistakes like this. I have walked into women's restroom by mistake. The issue here is she pulled a gun and fired. She is responsible for the death of a man who's only mistake was not locking his door. I think she was over charged with a murder charge. I do not believe her intentions were to go to his apartment and kill him. She opened the wrong door and killed the occupant. This is not murder but her negligence caused the death of a man. She should have pay for her crime. Manslaughter should have been the original charge and she should serve 5 to 8 years in prison.

They're all minorities. Whites have been minorities in Texas since 2003.
