Well, that will be decided by the ECJ. Personally, I think that France has some good arguments. Especially when Italy keeps "sending" refugees over the border all while ignoring their duties according to the Dublin Regulation.

Personally, I think that what France and Italy are doing right now is just a long term con to press for reformation of the Dublin Regulation. Which is desperately needed.
Both letting refugees to other countries and blocking the border for refugees isn't inherently wrong. It opens the eyes of other member states that ignored the issue until now.
