Nope. When you have the writ served that is their notice. If you want to work with them you still can but I'd expect cash upfront for any delay in enforcing the writ.

Nope. When you have the writ served that is their notice. If you want to work with them you still can but I'd expect cash upfront for any delay in enforcing the writ.

got the call from court today. all documents are ready to pick up.
thanks god they did it so fast. now i can pick up tomorrow and ask them to leave.

Do you think these folks are longtime locals or recent transplants? If locals, you'd think the judges and court clerks would know them if they do this everywhere they live. You'd think at some point they'd get tired of moving every few months also.

As I mentioned many posts earlier, evictions happen fairly quickly in Hawaii -

The next step is to try to collect your back rent or damages, hopefully you did collect a full security deposit

You'll need to file in small claims court, which is fairly easy - but they will need to be either sign the return receipt on the court document you mail or be served.

Winning is easy for the rent since you have the eviction - damages are tougher, hopefully you have good before/after pictures if needed and you'll need receipts.

Collecting - well, that is the hard part. If they don't pay you voluntarily you can get the money out of bank if you know the account number (for instance if you cashed any check from them) and the options get harder and harder.....

Yea! The writ still needs to be served third party. They have every reason to avoid you. I had a buddy serve and then went right behind and told them I'd give them 30 minutes to be out. They called the police. Police were mean to me until I showed the court order and suggested I'd follow their instructions but would notify the Judge of their actions.
The police eventually negotiated a $3000 check to me from their Pearl Harbor boss to not force them out on the spot..
Will you call the police? What will you do if they offer a check? Even if you take money that DOES NOT cancel the writ. Be prepared.

i probably wont except any check from them because of bad check they gave me from security deposit. probably call the police if theyre not moving out.

idk if they are the local but thier id are from LA

If they bounced a check on you you could file criminal charges or at least threaten to.
