You are assuming that Texas will grab people as soon as they enter the country. If that is the case, then Texas is required to inform CBP immediately and turn the person over to CBP. Texas has zero jurisdiction over people entering the country.

If the person is being held by Texas, CBP will request that he be released. When Texas refuses, the Feds will go to court and a Federal judge will order the release to CBP, and probably sanction the State of Texas.

The more likely case is that DPS is going to detain people who are brown and speak Spanish, even if those people are in the country legally. Once that happens, Texas is going to be on the hook for millions in compensation for illegal detention.
