But what if I can get a supervisor (of which there are quite a few) to say, "Yes, I've called people when they didn't show up." I can think of a couple who have, or might admit it to me. If they didn't want to appear as a witness, I could subpoena them.

They were afforded that opportunity, yet I wasn't. Even the UI person was like, "What, they didn't even bother to call you on that day?"

Also -- WHY would HR sound so rosy and optimistic about getting UI? She literally acted like it was a cinch. I just say the right things, I'll be fine. Why give someone false hope? Seems cruel.

I want to fight it.

In the end, I think it's time I got out of this dump and move -- I hate it here -- and if possible, to a non- right to work state or join a union.

I guess I'm curious, at least as a learning process, to see how it works.

My boss said this: "I've been to two hearings and the employee won both times."

I don't expect that they will praise me. The facts are the facts, I didn't show up on a day I was supposed to be there.

I will argue that on at least two occasions, my schedule was changed mid-week and I was not informed of it. I would later come in and be asked where I was. I would then say no one called, and my supervisors should shrug it off. It was clear they realized they just messed up. I would always think, "Wow, that is unprofessional."

I also know this happened to many other people. So there is no way for me to know if that was the real schedule. They had established a pattern of randomly changing it and not informing people. I still believe I wrote down the correct schedule.

People make mistakes. One mistake, in my case, destroyed my life.

I worked with a guy who had MURDERED someone and was awaiting trial, yet still worked there (legally, they probably could not fire him, but it was creepy).

I worked with a guy who had THREATENED TO KILL SOMEONE on the work grounds, in front of customers, off-duty, while drunk, yet nothing happened (he was actually the one who informed me I was let go).

I worked with someone who, in uniform, would walk up to their post with a cigarette in hand, smoking, in front of customers.

So... it's frustrating.

Actually (Having been unemployed for a good part of 3 years), I don't think OP will have any trouble.

1. The casino would have to try to fight his benefits. When he calls to sign up, Unemployment will send a letter to his employer and ask if they want to dispute the claim. If everything went the way OP says it did, then they *shouldn't* do that.

2. Even though he was late, and his schedule is his business, to be denied benefits, the casino will have to have good cause for letting him go (multiple instances of his wrong doing. Not just one). Unemployment seems to be getting fairly strict with employers about this. With so many people without jobs, as an employer, you'd better have a good reason for letting someone go.

Just stay calm, don't lie or embellish, and just state your case. You were indeed late, but only one time. Perfect record other than that. Then the casino will have to prove otherwise (and if you're honest, they won't be able to).

"Right to work" state has nothing to do with this issue, by the way. It's not the same thing as "employment at will" which is in play here.

Like the Culinary or Teamsters union will help you out with this type of issue. They are good for collecting union dues and managing your health and welfare benefits. Casino work is not for the lazy or sissies these days. You need to be on top of your game at all times to survive. Checking the schedule daily before you leave should be in your casino survival skill set.
