A hearing was held Friday for the ongoing lawsuit of Virgil Beagles vs. the Timberon Water and Sanitation District, and the judge relieved Michael Nivison of his duties as receiver for the district.
According to court records posted online, the lawsuit started in July 2008 with a complaint alleging the TWSD violated the Public Records Act. Dennis Karnes was appointed as receiver for the TWSD in August 2010, then he was removed from the position in July 2011 and Nivison was appointed receiver.
Zachary Cook, attorney for Nivison, said during the hearing Friday that Nivison has heart problems so he wants to resign as receiver and focus on his health. Nivison added he had seen no significant benefit from the heart medications he was taking, and his doctor and cardiac specialist advised he discontinue his service to Timberon.
According to court records posted online, all 12th Judicial District judges were recused from the case by the plaintiffs, and the state Supreme Court assigned 7th Judicial District Court Judge Matthew G. Reynolds in August 2008. Reynolds conducted Friday's hearing via video from Truth or Consequences.
Reynolds said Beagles' attorney Doug Perrin had filed an objection to Nivison's motion to resign as receiver, with the primary reason being Perrin wanted to keep open the possibility to object to Nivison's discharge from liability for malfeasance. Reynolds said he considered that when he issued his order Thursday, part of which he read.
Yes this article suggests an ongoing struggle to straighten out the water issues in area, just hoping that after elections someone is put in place to make some changes and insure water system gets out of financial burdens and hopefully insures golf course stays up and running
There is an election going on Jan. 10 for the re-election of some of the board members plus there is an open position which belonged to Virgil Beagles but he is not re-running. There are 2 people running for this position (position 5), my husband being one of them. It's a good thing V. Beagles is not re-running because he is a destroyer of Timberon along with his brother Dwayne.
There is also another court date Jan. 13 for the judge to let us know if we will get another receiver or if the board will take over.
Basically, the main problem is the Beagles wanting to sue everyone and destroy Timberon. Other than that, Timberon will be straightened out as it's being planned on now.
It was sad to see Mike Nivison resign as he's been the receiver for us for a few months and has accomplished a lot of things as he also did in Cloudcroft. I wish him the very best and hope that his health improves.
thanks for info, from what I have learned Beagles was indeed bad for Timberon, I hope your husband gets in there and gets the support he needs and gets it all straight, do you know if you have to be a NM resident to vote or just own property in timberon? Other than the water issues Timberon seems perfect!
You have to be registered in NM to vote whether you have property here or not.
Timberon is a great place to live with good neighbors. Yes, there are a few jerks here but overall, the good far outweigh the bad.
I believe the water dept. will get itself straightened out, maybe not this coming year but the year after hopefully.
Power has gone out several times today but just for a little while at a time.
Hopefully, it will stay on now.
