There's an apartment building at the end of my block that has what appears to be a driveway. However there are no curb cuts, yellow lines or any other markings that would indicate it was a driveway. There are no gates, just a wide pavement that leads to the backyard. The building manager keeps giving me crap about parking in front of it. Can the building manager have my car towed for parking there? Are there any laws in New York that require driveways to have curb cuts? How else are we suppose to know that it's a driveway? All the other houses on my block have driveways with curb cuts.
My understanding is they need curb cuts, yellow lines, and a posted sign. As to your situation, if they call the NYPD and they issue an authorization to tow, you won't likely win a lawsuit to recover your expenses.
This guy's setup sounds illegal. If you want to stick it to him, report it.
Your neighbor is in a Catch 22 situation, it seems to me. If he is saying it is a driveway, then he needs it permitted and it will require a curb cut.
If he is saying it it something other than street parking, like a patio, a paved over yard or whatever, then he can just shut up about it. You could send the bldg mgr and the property owner of record certified letters with return receipt requested, telling them, their agents, employees and assigns to stop harassing you about parking on a public street. That would give you some ammo in the event they ask for a tow.
I followed the link but couldn't find any information regarding curbs in the building's department search results.
If it's a driveway, it requires a curb cut and a P/W 1 PW1 Plan or Work Approval must be applied for and obtained. You sort of have to read between the lines.
My neighbor across the street deceided to paint his curb cut bright yellow. I did the 311 thing on the computer, in about 3 weeks, the yellow paint was re painted balck. The the next door neighbor in the mean time did his yellow, I did the 311 thing again, and 4 weeks later, his yellow line was painted gray.
We know its a curb cut, we know not to park there, and you are not entitled to paint your curb cut yellow.
I get such a charge out of reporting people on this yellow paint thing.
LOL, oh well.....
I am also thinking about how I can report someone else for parking over the curb on the sidewalk....I cant figure that one out as of yet.
