Beat me too it was going to make the same point, but another one is why would we want the POTUS to have that much power where he decides if you should be turned over to the military.
Because the U.S. news has already covered how changes in the legislation point out how the President demanded changes to make sure that CITIZENS would not be handed over to the military and indefinite detention or Guantanamo...in this piece here. The Patriot Act is another deal all together.
The admin specifically wanted wording removed from the legislation that would have protected US citizens.

Do you think it's okay to hold anyone without trial? Constitutional protections don't just cover citizens.
Frankly, the whole Jose Padilla ordeal is proof enough that the Federal government is willing to detain US citizens without trial regardless of legislative approval.
The Padilla fiasco is exactly why they want this worded in law. The Bush admin claimed the executive branch has the authority to do as they did so off to the court system the whole thing went. This bill spells it right out so there is no legal recourse.
At least now we'll have a place to put him and his useful idiots!
