It's not and shouldn't be.

Claiming something is true about someone that isn't, shouldn't be protected. For example, if I printed something up about Santorum and Gingrich going into a gay bar together, that might ruin their neocon reputation.

You know that one of the main reasons we don't have the public political mudslinging here in Canada like the USA is because you WILL be sued for sure if you slander or libel someone. A politician can not be sued for something he says in the house of commons so you often get the object of some abuse challenging the abuser to repeat it out of the house. If you refuse to do that you are shown to be nothing but a whimp and a bag of hot air. If you do repeat it out of the house you had better have your facts straight and your lawyer standing by.

I'd think she might fall into the "public figure" category since she testified, but that's certainly open for debate. If she is deemed to be a public figure, it makes it pretty tough to win a libel suit, particularly since he issued an apology. Even if she wasn't considered a public figure, I think the apology pretty much brings an end to any hope she may have had of winning a lawsuit.

I didn't hear the show so don't know what all he said in reference to her, but I'd imagine it would be understood that he was giving his opinion -- something that Rush is pretty good at. I'm sure listeners knew he wasn't trying to break a news story that indeed she's a prostitute. He gave his line of reasoning, I imagine, and stated that (to him) demanding payment [birth control pills] so she could have sex was (like) prostitution.

I'm not defending Rush. He's so far out there that this doesn't really surprise me. I get a kick out of listening to him now and then, but a steady diet of him would drive me insane.

Diet and Rush are not two words the come to mind.

Nevertheless, he made comments about her alleged behavior and built a case for his comments. As far as public figures are concerned, doesnt' the national enquirer get sued by public figures
