A 13 year old California girl is dead after a tonsillectomy operation to relieve her sleep apnea. She woke up, had severe bleeding, went into cardiac arrest, and was declared dead 3 days later. She is currently on a ventilator but the hospital says she is dead - not in a vegetative state. The family believes she is still alive and can recover, have blocked attempts to disconnect, and are looking for another hospital to take over her care. They believe they have found one in New York. The hospital says they will need clearance from the coroner as they have declared her dead. I understand a parent's denial - but it's time to let go. NBC indicates (see below) that there is more information that they are not allowed to disclose that will put the hospital in a better light.

We want the public to know that the family has not permitted us to discuss the medical situation. We are unable -- without the family’s permission--to talk about the medical procedure, background or any of the details that are a part of this tragedy. Details that would provide transparency, openness and provide answers to the public about this situation.

We implore the family to allow the hospital to openly discuss what has occurred and to give us the necessary legal permission--which it has been withholding--that would bring clarity, and we believe, some measure of closure and deeper understanding of this medical case.

Many of the statements made by the family and its attorney must be taken in the context that they will not allow CHO to discuss the case and provide the information necessary for there to be a fuller understanding.

Default Jahi McMath-Courts overriding medical professionals

No matter your stance on the case are you bothered by the fact a judge is overriding medical professionals, including professionals appointed by the court? It truly scares me that the court has now twice in this case overridden medical professionals. Thoughts.....

what about the families wishes? Medical staff at one hospital overrides their wishes? That's what this is about, the court giving the parents time to file legal papers.

The child is dead. No parent, should, want their child to be dead but it happens every day. The court appointed doctor agreed that she wis dead. There is nothing that can be done. Her brain has not had blood flow since 12/9. She's not going to get better.

I thought the Coroner's statement was interesting; something like "We are not dealing with a person in a persistent vegetative state here, we are dealing with a dead body!"
This was in response getting permission to ship her to New York.
While I can understand the "Never give up!" attitude of the family, there comes a time...
Especially when competent medical opinion says repeatedly "NOW is the time!"

I realize it sounds crass and mercenary, but it must be asked: WHO is paying the medical bills?

I have no idea who is paying, but my guess is no one. Medical insurance only covers living people. She has been declared dead by 3 different medical professionals.

Tragic story. But Jahi's family is in serious denial. The poor girl is dead. There is zero electrical activity in her brain. No pulse, no respiration, except as provided by machines. The McMaths are hanging their case on the fact Jahi's displays the occasional involuntary twitch (Lazerus Syndrome).

The hospital and medical community are bending over backwards to accommodate this irrational and ignorant family. The hospital wants to use their resources for LIVING patients. Instead, judges keep intervening, Turing the ICU into a weird impromptu morgue.

Maybe some RTL group will step up with the $25 thou a day it would cost to keep the status quo? Otherwise, time to pull it.

Which is why the fact that the courts are allowing this to go on is sickening. No need to worry about death courts because even if you're dead the court will never remove support.

It doesn't matter. Doctor's don't have the right to pull any plugs against the legal parents wishes.
