Others from your state have brought up DP is not restricted in SC to 1st degree murder. But again, I want him thinking about that kid whose life he'll miss out on.
That was me. It's not but there are 12 criteria and the crime must fit one of those to be a death penalty case. I think the third one could fit.
The "aggravating circumstances" are:
Quote:
(1) The murder was committed while in the commission of the following crimes or acts:
(a) criminal sexual conduct in any degree;
(b) kidnapping;
(c) trafficking in persons;
(d) burglary in any degree;
(e) robbery while armed with a deadly weapon;
(f) larceny with use of a deadly weapon;
(g) killing by poison;
(h) drug trafficking as defined in Section 44-53-370(e), 44-53-375(B), 44-53-440, or 44-53-445;
(i) physical torture;
(j) dismemberment of a person; or
(k) arson in the first degree as defined in Section 16-11-110(A).
(2) The murder was committed by a person with a prior conviction for murder.
(3) The offender by his act of murder knowingly created a great risk of death to more than one person in a public place by means of a weapon or device which normally would be hazardous to the lives of more than one person.
(4) The offender committed the murder for himself or another for the purpose of receiving money or a thing of monetary value.
(5) The murder of a judicial officer, former judicial officer, solicitor, former solicitor, or other officer of the court during or because of the exercise of his official duty.
(6) The offender caused or directed another to commit murder or committed murder as an agent or employee of another person.
(7) The murder of a federal, state, or local law enforcement officer or former federal, state, or local law enforcement officer, peace officer or former peace officer, corrections officer or former corrections officer, including a county or municipal corrections officer or a former county or municipal corrections officer, a county or municipal detention facility employee or former county or municipal detention facility employee, or fireman or former fireman during or because of the performance of his official duties.
(8) The murder of a family member of an official listed in subitems (5) and (7) above with the intent to impede or retaliate against the official. "Family member" means a spouse, parent, brother, sister, child, or person to whom the official stands in the place of a parent or a person living in the official's household and related to him by blood or marriage.
(9) Two or more persons were murdered by the defendant by one act or pursuant to one scheme or course of conduct.
(10) The murder of a child eleven years of age or under.
(11) The murder of a witness or potential witness committed at any time during the criminal process for the purpose of impeding or deterring prosecution of any crime.
(12) The murder was committed by a person deemed a sexually violent predator pursuant to the provisions of Chapter 48, Title 44, or a person deemed a sexually violent predator who is released pursuant to Section 44-48-120.
Some people don't care about the law. They have their own idea of what justice is. Ferguson is an illustration of that. This case may be also. We'll have to wait and see.
While I genuinely believe locals wouldn't' riot here, I'm more concerned about 'protesters' being bussed into the area.
Honestly, I don't care what led up to this or what this guy did in his past. The fact is that he was shot in the back while running away unarmed.
How did Slager know that he was unnarmed? We know that in hindsight, but not once during the traffic stop did Slager ask Scott to step out of the vehicle and search him. He calmly and respectfully inquired about the taillight and insurance, asked for a driver's license, and went to check it on his computer. Scott ran and could have had a weapon for all Slager knew. All Scott had to do to not be shot was stop running.
I personally find it disgusting that there are those calling for the death of this man when he hasn't even been tried or convicted. What ever happened to innocent until prove guilty? This man won't be able to get a fair trial because an incident in which he only had seconds to react has been blown up and sensationalized by an out of control media. The people who are calling for blood should realize that having such ugly thoughts is equal to murder. Hope you are proud of yourselves, not.

I CARE ABOUT JUSTICE being brought to the forefront. I wonder what you CARE about w/ such a passive position you appear to be taking regarding this CLEAR CASE of over the Top Murder, attempted cover up by one, two or more SC Policemen, etc.

Attitudes as yours, Ignorance and posts like this is what is Disgusting !!!
The cop shot a man with no chance. Scott obviously was running b/c of past warrants....and never dreamed a cop would ''gun him down'' ...as Slay-ger DID. = That fact is far beyond DISGUSTING.

You are free to have your opinion, but it does not help matters it only makes them worse. It is a sad commentary on the state of our society when the foundations of justice can be undermined because of a few loud voices and a undisciplined media. Can't you see that even if Slager is found guilty that he will be able to successfully appeal on the grounds that the jury pool was biased against him, aptly demonstrated by your childish remarks? We ought to respect the system of justice. That system allows for a person charged with a criminal offense to be considered innocent until proven guilty in a court of law. That should include not poisoning the well of the potential jury pool with irresponsible and bombastic rhetoric broadcast by the news media. The end result is favorable for justice in that it both protects the rights of the defendant and ensures the validity of a guilty verdict should one be given. If you really think that Slager is guilty, the last thing that you ought to be doing is calling for his blood prematurely, and from a human and moral perspective, I would argue that you should refrain from doing so at all. Lets reserve judgment until all the facts come out.
southbel, I doubt you will see protestors as your pd handled this properly, treating the executioner like the common felon he is. The communities which saw protests had a far less forthcoming pd.
Now they need to follow through with a super aggressive prosecution, and fellow cops testifying as witnesses for the prosecution.
But unlike pds which saw protests, yours has handled a horrific murder superbly.
