what do you think after today's oral arguments?

It seems Kennedy will be the swing vote and he kept us guessing on what he might vote

I've seen some speculation of a mixed decision, in which states can decide whether or not to legalize it, but would have to recognize marriages in other states. I could see Kennedy going with that.

I was taken aback. It did not seem very encouraging for gay marriage advocates. Expect the court to allow states to decide while being compelled to accept other state marriages. This is the sort of cutting the baby in half thing this court does. All the voting to repeal the bans in 2016 will mean a bigger turnout. But for whom?

Actually it was, besides the first 45 minutes he mostly pressed the states lawyers. A lot of his arguments are the same he used when he struck down Windsor as well.

The best conservative argument for allowing gay marriage is that there is nothing in the Constitution preventing it.

That would not be a split decision. If someone can end run around one states laws by going to another state, it renders the state law moot.

Maybe. Or maybe he was doing his best to draw out *all* the arguments against SSM, so he can make sure to address them in his response, whatever form that takes.

I am quite sure that all 9 of them are aware of the historical importance of this decision, and want to make sure that all the pertinent arguments are defined and responded to.
