Misdemeanor would hardly equate to a loss of citizenship or even a year in jail. But if you assault someone, you could be facing jail.

I think the bottom line is this,

Either you have freedom of speech, or you don't.

So burning flag should be legal, 100%.

But if you cause bodily property damage because you started fire, then don't say your FREEDOM OF SPEECH is violated.

Because they can't. I do NOT have to get a permit to exercise my free speech rights ever. Some yahoo may decide that they want to charge you but the charges will never stick.

You MAY go to jail for starting a fire without a permit. The violation is starting a fire without a permit / not your first amendment rights. Relax
