It's one thing to say that a federal statute or an executive order does not pass constitutional muster. But if the Constitution authorizes the prosecution of individuals for engaging in certain activity, I'm not sure how it would not pass "constitutional muster." That's sort of like saying the Takings Clause doesn't pass constitutional muster. If it's provided for in the Constitution, then it's Constitutional until Congress and the states repeal it or make a superseding amendment.
There's no precedent under the Logan Act, but a lack of precedent doesn't mean it's impossible to prosecute someone under it. Every law at some point has a lack of precedent including the RICO statutes, mail fraud statutes, etc.
He knew at least 17 days that Flynn lied about these Russian phone calls. So why did he wait so long before forcing him to resign? He's very quick to fire people who disagree with him on any other matter
