Our local bars and restaurants went no smoking a few years ago. Every one of them say that business increased after the ban. I also don't think that people should smoke around their kids. Why poison their air?

I have always believed that it should be left up to the bar owners on whether they want smoking or not. When the ban went into effect here in Colorado most of the popular bars adapted and built patios.

Assumption of Risk:

The elements of which are that the person voluntarily and knowingly assumed the risks inherent to the dangerous activity. Furthermore, it is necessary for the defendant (the person the lawsuit was brought against) to demonstrate that the plaintiff knew of all risks at the time of the injury.

People expose themselves to dangerous and/or hazardous activities every day. Driving, riding a roller coaster, skiing just to name a few.

Bar owners should be allowed to decide on their own accord if they want to allow smoking in their establishment. I'm from Newport, RI and have friends who are bar owners. The smoking ban decimated their businesses. Not the high brow bars and clubs, but the local taverns and bars.

Smokers are some of the most inconsiderate people on the planet.

Being forced to walk through a cloud of second-hand smoke is unacceptable, even if it is outdoors.

There is no option to keep indoor ban and leave outdoor situation as is.
