As per US government data, 2.2 million H1B petitions were filed between 2007 to 2017 by Indian citizens.



How many of them were filed by such scrupulous Bodyshopping IT companies is anybody guess !!

Most hold GREEN CARDS. They are not citizens. I work with lots of them.

It is not about H1B only. Lot of work is outsourced to India. L1 visa holders come and work. Consulting companies have recruited lot of F-1OPT students as well as H4 spouses.



Somehow focus is only on H1B visas.



If H1B gets banned, other avenues will be utilised.



Outsourcing can never be stopped as it is cost cutting measure for the corporates.

H-1b abuse is a game that both political parties play. They are far more responsive to their lobbyists than their constituents. In the book "Sold Out" by Michelle Malkin and John Miano Hillary, Clinton is quoted that "she could run for the Senator from the Punjab and win".

Judges won't issue rulings against powerful corporations. A prime example of that is Perrero v Disney. Disney was accused of lying on H-1b applications and conspiring with an H-1b firm to replace Disney's American staff. The judge sided with Disney and didn't mention the RICO accusations. The deck is stacked against us. A hundred twenty years ago when the Irish started organizing, the wealthy flooded the job market with southern Europeans.

I can only say that when you hear the word union, don't dismiss it as a possible solution. Unions have stopped mass layoffs cold. A lawsuit started by the AFL/CIO will have much more behind it than any individual.

Yes, it takes a very long time for an Indian to even get a green card, typically over 10 years.

5 years on Green Card and you will become US citizen. The real delay is on getting Green Card as per country quota cannot be exceeded and lot of Indians are in the waiting list. Because of huge numbers, the waiting is not moving past 2007-2008 date. Based on my Indian friends timeline,



1) One Indian IT friend came to USA in 1999, got his Green card around 2008, became citizen in 2013.



2) One Indian IT worker friend came in 2004, filed for Green card in 2009 and is still waiting.



People who came in 1990s surely got their green card and citizenship by now. Those who came after 2000, it depends when they filed for I-140 PERM, whether it is EB-2 or EB-3 category.



Visa bulletin tells about the dates when they are eligible to apply for green card.

For many people on H1B visa, this is their home. Their wife is with them, children are born here, parents are also with them. Many people have amazing patience. An Indian friend of mine came on student visa in 2004. MS, 7 year Ph.D., 6 years on PostDoc and only this year he got a job on Academic H1B visa. He is expecting to file for Green Card under EB-1 (highly skilled) category in 2019 and then there is further 6 year wait for green card. He is hopeful of getting Green Card in 2025 (21 years wait). He didnt go to India all those years due to fear that he may not be allowed back. Stockholm Syndrome !!!

Companies with 5 BN revenue are not body shopping companies.

I have met several Accenture , IBM employees hired in India and coming here in H1B visas. Cant they hire here instead??

Proper companies (Acenture / IBM) hiring skillful people are fine if they cannot fill their replacements here. This was the purpose of the program. Universities hiring Ph.D. are fine as per their requirement.



The abuse has come from small bodyshopping companies with inflated Resumes, taking money from OPT students to file H1B visa for them, entry level jobs, firing American workers and replacing them with cheaper labour.


There should be an overhaul of the system.
