Notice harshest assessments here are from Indian labor reformers who've been shafted by this process them selves. And as for the metaphor about other country's attitudes, it's a good snap-shot of how they view this issue. The rest of the world thinks the US is bat-s--- crazy for allowing a policy like H-1B to knock down their own citizens wages and discriminate against native born workers. No other country tolerates this, and the punishment is indeed extremely harsh in almost any other country for a company or execs who use cheap foreign labor (yes, indentured servitude which is what H-1B is) to displace local workers or reduce wages by basically enslaving and abusing desperate foreigners. This is considered one of the most, if not the most despicable business practice imaginable in virtually any other country, not just in Europe but Asia too, and it's dealt with very harshly.

Only two categories of people can understand this mess :-


1) American IT workers displaced by Indians

2) Indian IT workers in USA in Green ard wait conundrum.



Americans in other fields do not get displaced by Foreign workers. Workers from other countries get Green Card in 2 or 3 years while on H-1B visa and they move on.



This program was not intended to be one field (IT) and one country (india) specific.



This is what happens when you dont reform the visa process. Since 1999 in last 20 years, it has been one way traffic.



Solution needs to be found by government / Industry of these two countries.

Or make a country reservation like we have in Diversity visa Lottery. In GC Lottery, no more then 7 % visas can be issued to applicants from one country.

Do it in H-1B visa also- India should not get more then 7% of H-1B visas out of total. If applicants from India are less, the Green Card waiting time period for them will also come down.


These reforms should have come earlier-20 years ago. This human tragedy of abuse of visa holders and displacement of local workers would not have happened.

Taking away passports or false promises is an exaggeration. They are neither uneducated nor going to Saudi or UAE. The expectation is to go back at the end of their term but that always doesnt happen. Before coming prevailing wage is determined by DOL and they are paid that.

And asking as to why they are here in the first place is not for you or me to decide. $ decides it.

Great proposals, like you say what makes H-1B so terrible is how almost everyone loses, the Indian workers are lured in by false promises and talk by the body shops then subjected to indentured servitude, horrible abuses and underpaid when they get here, while American workers are displaced and wages fall while cost of living goes higher. I'd also add introducing salary minimums well into up in 6 figures, and keeping the visa in the hands of the immigrant not the sponsoring company, which too often is a body shop like Tata and Infosys that keeps the immigrant in virtual slavery and indentured servitude, not free to bargain for better salary, working hours or look for a new job

There is a lawsuit by an IT advocacy group representing around 1000 small companies (mostly owned by Indians) called ITServe Alliance based in Dallas, Texas against USCIS.

If India stops buying oil from Iran may and stop paying in Rupee may be it can be saved .

That will be fascinating to see. wonder if they'll be introducing minimal salary requirements, and giving H-1B holders power over their visas instead of employers therefore the freedom switch jobs? Maybe turn the H-1B into an auction instead? A lot of suggested reforms but these seem basics to change the H-1B from an indentured servitude visa full of abuses and basically a form of human trafficking, into something that genuinely does allow for recruitment of talent to fill real gaps, not displacing Americans for key tech jobs like what Disney did. Would also make the H-1B more like what Europe does, where foreign recruits must be paid same or higher than locals and enjoy same freedoms as locals to change jobs, not be used as cheap slave labor.

The worst irony is, the Indians brought in thru these deceptive Bodyshopping firms, with the nasty middlemen basically owning them, are so poorly paid for their hours they often wind up in debt, that is they wind up worse off than if they just stayed home. For unscrupulous US corporations, this of course is a "benefit" by cutting labor costs (which is why Americans aren't getting hired or paid well for STEM jobs), while the Indian Bodyshopper human trafficking firms make out like bandits by basically treating the exploited Indian indentured servants like cattle.

Bolding mine. STEM work is a white-hot seller's market, or at least every part of it that touches writing code. No clue how you could reach this conclusion. The demand and pay would be even higher without H-1B, yes, but it's certainly nothing to complain about presently.
