Say, a college sees this photo and there's little Johnny Smith throwing up the good ole Sieg Heil for all to see. I predict there will be consequences for public universities making such decisions. They cannot or should not eliminate students based on their political beliefs. They're required to pay lip service to the 1st amendment.

What are you talking about? A school can punish a student for things they did off campus.

Of course there is legal recourse. When it happens on some individual basis, people may choose not to sue because it's expensive but these boys (their families) can pool their resources and sue. And they'd have a case. It's a public funded entity discriminating based on speech. It will definitely find itself to the USSC.
