The House wanted the tapes, they got the tapes. Comparing that one request to the hoops this House would have had to jump through is not comparable.
So you agree that they would have to get a ruling to force the issue and claim obstruction. It doesn't matter the hoops, they still have to go through the process. They can't shortchange it by just declaring the right with no basis in history or court ruling to support the contention - it takes even longer if you never start the process.
Depends on the setting. There is no expectation of privacy in a public setting which includes large dining areas. Also Fruman the other goon of Giuliani’s was the recorder. PBS has published the video.
Expectation of privacy is different issue - 4th amendment. In a 2 party consent state - ALL parties must be informed and consent to being recorded for ANY conversation.
