He wasn't "just" running away, he aimed a taser (which is a lethal weapon) at the cops.
And the taser was empty and the officer knew it when he shot Brooks. So he deliberately shot a man who he knew was not armed. And the armament would not be very dangerous for an officer wearing a ballistic vest.
And he shot him in the back twice so he knew he was not charging.

In 1985 the US Supreme Court addressed this issue regarding a Tennessee law:
"The Tennessee statute is unconstitutional insofar as it authorizes the use of deadly force against, as in this case, an apparently unarmed, nondangerous fleeing suspect; such force may not be used unless necessary to prevent the escape and the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others."
Law enforcement should not be given carte blanche to kill suspects simply because they are running away. You've had cases over the years involving, for instance, the mentally disabled that didn't understand what was happening to them (the arrest) and tried to run, only to be shot dead.
I know it makes some feel good to find out, after the fact, that the dead person had a criminal record. But that is not how law enforcement is supposed to work.
If you go by that standard, you may someday be killed, with the police officer afterwards saying "Well, I thought the suspect had a criminal past".
Police are to arrest suspects. Using deadly force is allowed in limited circumstances. Otherwise, the suspect is to undergo trial by a judge and jury.
Strange that some have no regard for the 'law of the land'.

Did not blow double the limit. More like one drink over. And that is not enough normally to cause one to fall asleep. So it be interesting to see if there was something else going on. And he apparently fell asleep after parking the car and the officer had to wake him again.
Where I worked they taught us to never assume someone is drunk or high simply because they are acting drunk or high. Thats how you get the company and yourself sued. They could be a diabetic, there are also other medical causes for such behavior. Hell there is even a medical condition that makes people produce alcohol and get drunk from that. LOL
