I think the shooter claimed he didn’t know the other (and unconcerned) cops were on the immediate scene and also didn’t know the VIPs behind him had already exited the hallway and building. (Sort of the SGT Schultz defense.) So he shot her (he never claimed he felt personally threaded by the empty handed and tiny Ashli Babbitt).
Could readily see the Babbit’s prevailing in civil court. Or settling.

They breached the capitol while it was in session. They climbed walls and broke doors and windows to get in to overturn the results of the election. She was unfortunately a casualty of this insurrection because they were all told to stop and no one did. But she was the first to climb through. This was her own doing. There will be no court settlement because she was the one at fault.
If she had been shot in the back running away from the scenes of her crimes, we could argue that there was undue force, over reaction.

They do when it is convenient for them. But you and I know better. The officer wasn't only shooting to protect himself; he was shooting to protect a branch of the US government, and democracy itself from mob rule.

Reminds me of the dramatic descriptions of Trump supporters bashing in the skull of a cop with a fire extinguisher while murdering him.
