In court the standard would be how would a reasonable person interpret what he said

Their are almost 900 reasonable people facing felony criminal charges who will say we interpreted trumps words tO mean to physically fight to stop the certification.

As far as intent trumps lack of action despite his counsel ,aides and staffers pleading with him and the continued silence in the face of shots being fired and loss of life would demonstrate intent.

Consciousness of guilt can be seen in the lack of call logs during that time despite wide spread knowledge the president spoke with legislators in the capitol. You don’t hide evidence unless you know you have done something wrong.

Yea true, what happened after that certainly was on them. Trump left em hanging, as usual. Can’t take any responsibility, a lot of them are going to prison.

Some of the rioters, in their own words, recounted that they were doing Trump’s bidding. Now you can call them delusional if you like, say that his talk of fighting was rhetorical, but at the very least his poor choice of words if that were the case is plenty damning.

Now either he’s an incompetent boob who didn’t understand how his words would be taken by the mob, or he’s a master manipulator of the human psyche and he got his followers to riot at his behest.

Either way, it’s his fault.

In court the burden of proof is on the government and Free Speech and context always wins.
So you talked to the 900 reasonable people and they told you that Trump told them to trespass Congress and resist arrest? Amazing, you have some access.

Let them face the Courts. Many BLM rioters were arrested. Did Kamala paid their bail or she got what she wanted for from the beginning, votes.

Nope, it’s their fault and those that couldn’t control themselves are paying the consequences. Your claims that because Trump incited it are feelings/assumption.

No free speech does not always win. if you yell fire in a theater and a stampede kills a dozen people you can’t say it their fault for not leaving in an orderly fashion

The theater goers reacted how a reasonable person would upon hearing someone yell fire in a packed dark room.

The mob acted in a fashion many consider reasonable after being exhorted by the president of the United States to fight to save the republic.

If I say in a speech in a locker room to the team : "Fight hard, don't give in, be tough, push back" in the context of the game and a player chokes the opposing player how is that a crime for the coach? It would be thrown out of court because any lawyer would destroy it.



Context of a speech and words is everything in court. The Burden of proof in on the government to prove intent. Good luck.
