So they're in prison because killing a fetus is criminal (felony) homicide. Makes sense as killing any other human without cause is a felony homicide criminal offense.

Not every human who dies gets a death certificate. For example, in fetal homicide cases, the perp is convicted of fetal homicide even when the death of a fetus does not cause a fetal death certificate to be issued. Your question is moot.
