Trump would have had to de-classify them in writing while president or tell others they were classified while president and someone would need to have records of each document being declassified (when and how).

it was FISA Extension, introduced by Orrin Hatch, co-sponsored by 12 fairly evenly split between R & D. Passed the Senate by unanimous consent. R's in the House voted 4-1 in favor, Dems 2-1 against. Then after a minor House Amendment passed 2-1 in the Senate, with 7 R's voting no and 21 Dems voting yes.
What this will come down to is whether Trump declassified the documents and who actually removed the documents (for liability purposes). I don't even know the process for the president to formally declassify documents. Is it a simple "they are declassified" statement or is something more required? I don't know. I've seen procedures for general original classification authorities to declassify documents, but never for the president.
There’s a very specific way to handle govt documents. They are classified in a certain manner and can only pass certain hands or even travel on certain ways. They belong to the US govt. So taking anything is prohibited if not approved. Disposal of documents also is specified by time frames and process. When it comes to that- it’s very strict. I don’t know What they are looking for. Having docts can be illegal. Trying to hide docs that show some discrepancy - that’s bad.
He declassifiying anything does not change the correct way to handle the docs. Can’t throw them in the fireplace because changed the status of those docts.
