As president he did have the authority to declassify any documents. He did not have the authority to have those documents sent to his personal residence after he left office. Those documents do not belong to him but to the national archives. It's not a big deal if the documents were not classified but it is a very big deal if they are. Only time will tell which of the two it will be. Anything at this point is just speculation.

A president can declare something that is top secret to be no longer classified, and he doesn't even have to tell anyone.

The removal of classified documents literally becomes constructive declassification when the action is taken by the president.

The president has absolute authority to make whatever changes to the classified status of documents he likes and may do so any time he still retains the powers of his office.

No, he doesn't need to sign anything, hold a ceremony, make an announcement or anything else.

If the documents were removed while he was still in office, they are declassified by default.

Obama never recorded 300,000 documents he took with him when he left and Hillary destroyed 30,000 emails illegally.
They have the Hunter Biden laptop which incriminates Joe.. Seems like Hillary Obama and Biden should have raids sent against them.

Correct, it's written in law, he has the power to do it.

Declassified or not, he did not have the right to remove documents from the WH. It's not just about the classification of documents. Documents, including notes on napkins, texts, doodles, etc. produced while he was president require retention via the Presidential Records Act. The docs belong to the people of the U.S. The exception is campaign documents.

Regardless of what you might think about Hillary (the distraction), can you not admit that it is wrong to defy the law, even if you 'technically' find ways around it by 'getting someone else to physically remove the documents' or 'declassifying them for the sole intent of CYA'.

One thing for sure, he can't claim he didn't know it was illegal. HE IS THE ONE who strengthened the law to make it a Felony.


But honestly, to anyone, who supports anybody (Trump, Hillary, whomever), can't we at least agree that if someone skirts the law by exploiting loopholes and technicalities, that we still should call them out for their deeds. Even if he gets away with not going to jail for violating HIS OWN LAW, shouldn't everyone, his base, his haters, hold him accountable if he actually was storing documents in Mara Largo?

(If you think Hillary should be in jail too, that's fine, but this discussion is about DJT.)
