The republicans have held such investigations without there being democrats on such select committee as there are no Republican selected republicans on the January 6th committee?
Kevin McCarthy took his ball and went home when he tried and failed to put disruptive people and people who would be witnesses on that committee. He never put forth alternates. Kevin's own fault the Repubs were not better represented on that committee.

Republicans were given an equal opportunity to participate in the Jan 6th committee. They declined. Probably out of fear of retaliation from Trump and other members of their party.
Play stupid games, win stupid prizes. The judge, a Trump appointee, didn't think it was all a joke or just political theatre.
Of course not. The law does NOT say: "If Democrats in Congress abuse their power and put on grotesque, one-sided show trials after Republicans violate a few laws about trespassing and breaking windows, then it's OK if you DON'T prosecute the trespassers and window-breakers."
Nor should it. The judge had an obligation to uphold the laws, including minor ones. Democrat abuse of the entire process should not have a bearing on whether he should uphold the laws on trespassing, minor property damage, and wearing a silly Viking suit in the House chamber without invitation.
It was apparently for his refusing a subpoena from the Jan. 6 committee - a show trial disguised as an "investigation", staged by the Democrats where none of the accused were allowed to testify, and were never allowed to question the witnesses against them.
You mention the rules for a criminal trial, which this certainly is not. How many times has that been stated?

Regardless of feelings, a person still is required to answer a subpoena. Or does he get a pass because he 'did not want to'?
If he spends even one minute in jail, he is a political prisoner.
The formerly great United States is precariously close to a full-blown banana republic.
