To any who is being foreclosed on... even if your house is being auctioned... go to the county and say "Produce the Note" ... in some cases they can't because for many, the note has been sold on wall street, and therefore legally the sell must be halted.
I am tired of so much misery... of people's misery... so am going to say what I can Legally say... check on this at any consumer network. I can't give a link but anyone knowing about this... please find it for the people and post it in this thread.
Hopefully a good part of the "Stimulus Plan" will include help for homeowners to refinance. Regardless of whether they represent uninformed purchasers, the truth is , the bank would rather not be stuck with the real estate. Many of these banks should have never lent to such risky consumers.
My elderly mother was under foreclosure proceedings in 2007. She had been sick off and on and got behind in an equity mortgage. It just so happened that the bank note had been sold to another bank a year or two previously and she further confused it with another note. I was able to hook her up with a non profit state agency that assists elders with financial affairs. They arbitrated and succeeded in getting the note refinanced. The bank was more concerned with getting regular payments and having their legal fees covered.
It would have been a tragedy if my mother had lost the home she has owned for 60 years for two late payments on a $20,000 note.

What it sounds like you're suggesting is that in some foreclosure sales, the real-party-in-interest isn't forcing the sale (probably because they've been dissolved or acquired) ...?
There have been several articles online about this very topic over the past few weeks. Mortgages have been sold so many times, in some cases, that the original can be almost impossible to locate.
I'm going to go digging around and see if I can find some of those articles. BBL...

Is this helping or trying to stall the economy even further by doing something that will in the end makes no difference and people will even live longer in a home without paying and causing other homes to lose value...what a help and what is the difference...you sign the papers, you pay what you signed for...!

Have you ever done harm in business??? I shall balance mine, with good... No one's mortgage should have been diced into a million pieces and sold over-seas... That is a basic wrong THAT they didn't sign up for, weren't told about or given a choice to consider. People with such mortgages ... go and stop the sell now.

Way to promote lawlessness -- keep it up, Johnny Law will be at your door soon.

I think about a year or two ago, a homeowner, from Texas maybe, went through this very predicament in asking the deed owner to essentially show the deed in which they couldn't. I believe the guy actually got his house "for free".
Lawlessness has already been promoted thru silicing up people's mortgages and selling them overseas as CDS/CDO's...
Unless of course, that is morally principled, to your standards of business practice, in which case I bid you well. Thank you for your opinion.
I find it funny people are deriding you for this. Maybe the public, by taking this action of saying "produce the note" will set the equilibrium straight in what is called the housing market.
It's those same people who denounce "socialism" and "Obama" yet believe in the concept of free markets. Maybe, just maybe this is a prism of how the free market can correct itself.
Oh, the irony is rich...
