I'd like to see how s/he establishes that s/he has standing in such a case. Haven't all of the birther cases to date been thrown out for lack of standing?
Not all of them. But most of them, yes. At least four have actually been decided on the merits. Birthers lost all of those too.
Of course the primary reason most have gotten tossed on standing is because they have all been filed as civil cases. Had any of them been a criminal case, standing would not have even been an issue.
The Catch-22 for Birthers is that for a criminal indictment you actually need to have evidence of a crime. And of course... they have no evidence for any of their accusations, let alone the criminal ones.

i'd never heard of judy so i had to look him up. wow.
he plans on running on the democratic ticket to challenge obama's eligibility. since he won't get the DNC nomination i doubt he could be considered an official candidate for POTUS and therefor would lack the standing needed for a civil lawsuit against the president. it seems that the smarter option would be to try and get in on one of the smaller party's ticket ( i'm curious what exactly is needed to get a party/candidate on the ballot ).
