Well then you do what's good for you to cover yourself. This wasn't at all clear when you said, "I've just been screwed out of 3 months rent that I will probably never see again" from which I assumed you were referring to yourself and that you were in the same position as the OP. I do stand by my comments where grey areas are concerned and as Ultrarunner pointed out.

Hhahahaha...omg you're kidding, right? Right? He's not going to pay. OP needs to get his freeloading arse out of the rental asap, and if you were my renter I would have evicted you for non-payment because there's no guarantee your LL will ever see the rent you owe him.
