In some states they can be held liable, but not in FL(no surprise).

First, lets see about Dram Shop laws which cover selling or providing alcohol to intoxicated persons and having the liability if they do. 30 states have statutory provisions that allow licensed establishments such as restaurants, bars, and liquor stores to be held liable for selling or serving alcohol to individuals who cause injuries or death as a result of their intoxication. 22 of the 30 states statutorily limit the liability to cases where the establishment sold or served alcohol to an obviously intoxicated individual or a person under the legal drinking age. The 22 states are Alaska, Arkansas, California, Colorado, Connecticut, Florida, Georgia, Idaho, Indiana, Kentucky, Maine, Michigan, Mississippi, Missouri, Montana, Nebraska, New Hampshire, New Jersey, New Mexico, New York, North Dakota, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, Tennessee, Texas, Utah, Wisconsin and Wyoming.

So, in FL and 21 other states Dram laws apply, however there are limits to their liability.

Solution: Ban alcohol. Once and for all. Alcohol is a killer worse then heroin.

The wrong way driving situation is also an alcohol related problem with 75 percent of the wrong way driving crashes involve alcohol. Same solution. Get alcohol out of our society.

FL is not the only state that has this wrong way driving problem. In the US, about 350 people are killed annually in accidents caused by wrong way driving. Michigan, for example has had 110 wrong-way during the 5-year period from 2005 to 2009.

Too many people die from alcohol every day.

Thanks for doing that homework. I considered replying, to the post that insinuated this was only a Tampa Bay area problem, but didn't want to bother.....

Hopefully the motion activated flashing lights on the offramps will help.

I am just blown away that in this day and age, people are still stupid enough to drink and drive.

Looks like targeting DUI-checkpoints is another strategy. Read today that Pinellas had a set-up last night and nabbed a few.

He had been pulled over and arrested 3 TIMES in 2013 for a suspended license, never had the vehicle impounded.

So he kept driving, and ended up killing his own child.

Florida Dram Shop law is under Florida Statute 768.125. I am sure you will find some case law on it on the First District Court of Appeals website among other places.

Read through F.S. 322.34, Driving while license suspended, revoked, canceled, or disqualified
Specifically impounding is covered, in depth in Section 8, paragraphs a-f.

Statutes & Constitution :View Statutes : Online Sunshine

Section 8,paragraph (b) reads......

"(b) If the arresting officer finds in the affirmative as to all of the criteria in paragraph (a), the officer shall immediately impound or immobilize the vehicle."

The guy who ran over his own kid had 23 prior arrests. He is a career criminal. You expect a person with 23 prior arrests to have a license or insurance? Read his rap sheet. He was arrested numerous times for violating automobile laws. Surely his vehicle was impounded a few times as F.S. 322.34 8 (b) requires.

That should show you that impounding a vehicle as NO EFFECT.
