784.011 Assault.—

784.08 Assault or battery on persons 65 years of age or older; rclassification of offenses; minimum sentence.—
(1) A person who is convicted of an aggravated assault or aggravated battery upon a person 65 years of age or older shall be sentenced to a minimum term of imprisonment of 3 years and fined not more than $10,000 and shall also be ordered by the sentencing judge to make restitution to the victim of such offense and to perform up to 500 hours of community service work. Restitution and community service work shall be in addition to any fine or sentence which may be imposed and shall not be in lieu thereof.
(2) Whenever a person is charged with committing an assault or aggravated assault or a battery or aggravated battery upon a person 65 years of age or older, regardless of whether he or she knows or has reason to know the age of the victim, the offense for which the person is charged shall be reclassified as follows:
(a) In the case of aggravated battery, from a felony of the second degree to a felony of the first degree.
(b) In the case of aggravated assault, from a felony of the third degree to a felony of the second degree.
(c) In the case of battery, from a misdemeanor of the first degree to a felony of the third degree.
(d) In the case of assault, from a misdemeanor of the second degree to a misdemeanor of the first degree.
(3) Notwithstanding the provisions of s. 948.01, adjudication of guilt or imposition of sentence shall not be suspended, deferred, or withheld.

Lol...spousal privilege has nothing to do with this case. Watch the video, lol the cops don't care if Reeves is 71, they aggressively bend him over the theater seats and cuff him like the punk thug he is. He then struggles deputies as they go down the walkway.

Exactly, poor Mr. Reeves ... in this day and age of social media, he couldn't wait a few minutes until Oulson texted the babysitter during the movie PREVIEW ? Wonder what he did in the old days when people talked during a movie ... reported them one-by-one to theater management ? Wonder what he did when he saw drivers texting on the road holding him up ? Wonder what he did when he saw someone texting in the supermarket line and costing him precious time ? Angry old policeman might not do well in state prison ...

The video of Reeves leaving the theater shows him several feet behind the deputy who was taking him to the patrol car. Reeves was handcuffed hands in front of him carrying a bottle of water.

Resisting arrest? Witness tampering?

Never said he was a maniac ... but angry yes ... anyone in this day and age that gets upset at someone texting in the movie preview, yep I'd say he was angry. What ever happened to patience ? Like I asked before, what did he do when folks used to talk in the movies ?

And what do you think his "friends and colleagues" are going to say ? That he's a loose cannon prone to angry outbursts, a control freak ? What if he gets off ? Then what ?

Battery on a senior citizen is a felony.

Watch the inside theater video (left side camera). The big Pasco Deputy comes down the aisle, waives away Hamilton, grabs Reeves and throws him over the row of seats. Reeves is then stumbling around resisting, it gets bad when he gets on the aisle, one deputy pushing the other pulling a struggling suspect. Lol, he's clearly madder than a wet hen.

I don't know how he got through life without snapping earlier. My theory is that he brought that gun to the movies hoping some sort of Auroura scene would unfold and he would gun down a "joker" and be a hero. When that opportunity never presented itself, he had to create his own "bad guy" but it backfired on him. He shot a well respected, good citizen and he become a bad guy himself. Besides his attorney and a handful of others this guy is despised even by CCW holders and law enforcement.
