Thanks to the recent BLS Directive from KLHart62, I've just updated the FAQS.

In the process of very close examination, reading and rereading of the directive, I want to point out that the augmented Tier IV is only available to those whose states were in an EB period on 2/22/12 but who were not yet transitioned to Tier IV benefits on February 22.

Also, the Directive is very clear that the new UE rate triggers and tier reconfigurations occur as close to the beginning of June and September as possible.

Therefore, NYS at the moment has incorrect information on its website as to eligibility dates. Other states are unclear and, in some cases, I think are also in error.

All that said, claimants are still at the mercy of their individual states for proper implementation.

Certainly, discrepancies on eligibility due to incorrect state interpretation of the legislation/directive is an appealable issue, should it come to that for some of you.
