I'm a dislocated worker. I was part of a mass corporate layoff (banking) a year ago. I got approved for Training in a different field while recieving benefits in a vocational school they approved. The course was 9 months. The max you can collect is a year. My year was up a few weeks ago and I'm wrapping up my externship which should end in about 2 weeks. I applied for a new claim but EDD denied my claim because I didn't earn money to start a new claim. I want to appeal this denial, I feel I should collect untill I am done. Side note a friend with my exact scenario ( she attended training w me too) got approved for a new claim (after a year) and I did not?? She didn't earn money either and was approved because supposedly our bank had set aside extra funds for us, of course EDD doesn't want to hear this and I can't tell them to look at her claim. Anyways, do I have a chance? I just want a few more weks just so I can complete my training and look for work. Please advise! TIA.

On the surface, I say don't waste your time, but

Some people have no clue what really happened or just why it matters. Tell her to carefully examine her monetary award to determine if she truly made no money. It doesn't take but $1300 in most cases. Could be she had a straggling paycheck, misreported severance, a delayed performance bonus, and then lucky her. Maybe she worked part-time and forgot about it.

I originally thought it was the severance we received. Which spewed over till Feb of last year. So I thought I would be able to open a new claim as well, but I was told severance doesn't count as money earned. So theres probably no point in me appealing the claim right? I guess it wouldn't hurt to try. Worse they will say is no :/ I just don't understand why it wouldn't continue until I complete the training that they approved. Do you think maybe whoever gets the appeal will look deeper into any earnings that may be straggling like my friends case did? TIA

I'm thinking you need to get with your friend to compare notes. Could be she didn't tell EDD about the severance, and you did, and in her case it looks like "new" wages, and with you, EDD already knows it's not.

Anyway, with you, I think the decision EDD made was correct, and if she really did get a new claim, it might be because of a lucky accident.
