  • 229.164 (f) (2) (A) (iv) not covered. Observed bowl of cut cucumber stored in another bowl of unprotected cucumber. Also observed salad mixing bowl stored on top of salad mix. Food must be protected from cross contamination by storing the food in packages, covered containers, or wrappings.
  • 229.164 (o) (7) (A) consume by date (prepared). Observed unmarked bins of PHF and items past their assigned "use-by" date in various refrigerators. Refrigerated, ready-to-eat, PHF foods held for more then 24 hrs. Shall have a consume-by-date. The day of preparation shall be counted as day 1. If held at 41F or less food can be kept for a max of 7 days.
  • 229.163 (h) (9) contaminate hands. Observed employee open refrigeration unit and wipe gloved hands on apron then continue to handle Ready-to-Eat foods. Single-use gloves shall be used for only one task such as working with ready-to-eat food and discarded when damaged or soiled, or when interruptions occur in the operation.

An employee must eat, drink, or use any form of tobacco only in designated areas where the contamination of exposed food; clean equipment, utensils, and linens; unwrapped single-service and single-use articles; or other items needing protection cannot result. All personal objects must be kept away from food prep areas.
  • 229.166 (i) (1) (B) HWS improper use. Observed bucket stored in kitchen hand sink and a beverage dumped in waiter station hand sink. A hand washing facility may not be used for purposes other than hand washing.
