An employee must eat, drink, or use any form of tobacco only in designated areas where the contamination of exposed food; clean equipment, utensils, and linens; unwrapped single-service and single-use articles; or other items needing protection cannot result.
- 229.164 (e) (1) (D) (ii)Bare hand contact. Observed employee assembling a sandwich with bare hands. Food employees may not contact exposed, ready-to-eat food with their bare hands and shall use suitable utensils such as deli tissue, spatulas, tongs, single-use gloves, or dispensing equipment.
- 229.164 (o) (7) (B) consume by date (pkgd). Refrigerated, ready-to-eat food (pkgd cheeses) not properly marked with a use by date. Date mark refrigerated, ready-to-eat food that is frequently unwrapped or dispensed using an acceptable method as discussed.
- 229.168 (d) (2) (A) (ii) not according to label. Observed cans of household pesticides stored on shelf underneath soda dispensing machine. Use pesticides which the manufacturer's label instruction state that its use is allowed in a commercial food establishment or use a licensed pest control company.
- 229.163(b) Demonstration of Certification. PIC could not successfully demonstrate required certification (expired). A Certified Food Manager must be present at all times during operating hours.

- 229.164 (f) (2) (A) (iii) cleaning / sanitizing. Employees remove cold hold unit lids during operating hours, store them on floor and place them back on when day is over. If lids are going to be removed, they must be stored in a manner that prevents contamination.
- 229.164 (f) (2) (A) (iv) not covered. Observed bin of ham stored on top of pasta salad with no barrier in between. Protect food from contamination by storing food in packages, covered containers, or wrappings.
- 229.166 (g) (4) (B)backflow preventer. Observed water hose near trash area to have no backflow prevention device installed. Install the proper backflow prevention where ever hoses are being used.

- 229.165 (q)food contact not sanitized. Observed in-use knives stored on soiled knive magnet in kitchen area. Magnet must be cleaned/sanitized routinely. RECOMMENDATION: Remove magnet from under counter and place in area where food debris can be seen and easily cleaned/sanitized.
- 229.165 (n) (1) (A) (v)when contaminated. Observed ladle with food debris hanging on rack near stove. Ensure all utensils are cleaned/sanitized and stored properly when not in use.
