Overall food safety compliance in the facility has improved, relative to previous inspections - Thank you.
It is suggested that additional employees become trained as Certified Food Managers to help oversee food safety. Active managerial controls of food safety suggested in the facility include:
* Verifying safe food storage in refrigeration units at least twice each day.
* Verifying handwashing sinks are stocked and accessible at least twice per shift. This promotes proper handwashing by employees.
* Train employees in proper retention and dating of shellstock tags. Verify daily that tags are stored with the shellstock, dated with the date the last shellstock is sold/discarded, and the dated tags are kept for at least 90 days.

    Observation: A food employee failed to wash his or her hands before engaging in food preparation, after touching bare human body parts, after coughing, sneezing, eating, after handling soiled utensils, or after engaging in any activity that could contaminate the hands. Employee observed coughing into hands without washing before returning to task.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness. Hands were properly washed after reminder from EHS.

    Observation: The date when the last shellstock from the container is sold or served is not recorded on the tag or label. Tags are retained in the facility.
    Correction: The identity of the source of shellstock (oysters, clams, mussels) that are sold or served shall be maintained by retaining shellstock tags or labels and marking the tag or label with the date when the last shellstock from the container is sold or served.
  • Critical: Food Protection from Contamination / Separate Types of Raw Animal Foods (corrected on site) (repeated violation)
    Observation: Different types of raw animal foods stored in such a manner that may cause cross contamination as follows: Raw chicken and raw sausage stored above shellstock and raw shrimp in two door prep refrigerator.
    Correction: Raw animal foods shall be sorted by their "type" and cooking temperatures while in storage inside a refrigerator or freezer. For example, if using ONE shelving unit for storage of ONLY raw foods, the foods shall be sorted in this manner: 1) raw poultry (chicken, turkey, or duck) shall be stored on the BOTTOM shelf (165°F cook temperature), 2) raw ground beef and ground pork shall be stored on the shelf above poultry (155°F cook temperature), and 3) raw pork (chops, ribs), seafood, and shell eggs shall be stored on the top shelf above beef (145°F cook temperature). Foods rearranged. EHS provided refresher training.
  • Wiping Cloths/Use Limitation/Wet Towel Storage (repeated violation)
    Observation: Wet wiping cloths used for wiping counters and other equipment surfaces were observed stored on the counter.
    Correction: Wet wiping cloths are to be used for wiping counters and other equipment surfaces and are to be held in a chemical sanitizer solution at the appropriate concentration between uses.

    Observation: A malfunction in the freezer has lead to a large accumulation of ice on the floor and wall of the walk-in freezer.
    Correction: Maintain equipment in good repair. CFM stated that he is working with a repair technician to install a new drain for the freezer.
  • Cutting Boards / Resurface / Discard
    Observation: Several cutting boardin the kitchen are heavily scratched and scored. The food contact surface is no longer easily cleaned and sanitized due to condition.
    Correction: Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized, or discarded if they are not capable of being resurfaced.

    Observation: The following equipment/utensils were observed soiled to sight and touch: several knives in knife blocks at bread station.
    Correction: Equipment food-contact surfaces and utensils shall be clean to the sight and touch. A surface that is soiled cannot be effectively sanitized. Knives removed for cleaning and sanitizing. Clean interior of knife blocks. Ensure used knives are not returned to blocks without cleaning and sanitizing.

    Observation: Encrusted grease deposits and/or other soil deposits were observed on the food contact surfaces of several cooking pots/pans throughout kitchen.
    Correction: The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and other soil accumulations. A surface that is soiled cannot be effectively sanitized.

    Observation: The nonfood-contact surfaces of the following equipment were observed soiled with an accumulation of dust, dirt, food residue, and/or other debris: high and low shelving along both sides of cook line, exteriors of spice/seasoning containers, gaskets of refrigeration equipiment.
    Correction: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue and other debris to maintain a sanitary work environment and prevent pest attraction.

EHS observed significant improvements in food safety practices in facility relative to previous inspection. EHS provided additional training on retention of shell stock tags and disposition of dented/damaged cans. Please obtain and use stoppers for three vat sink drains. Please clean and maintain non-food contact surfaces (shelving, exteriors of equipment, etc.) clean.

    Correction: The identity of the source of shellstock (oysters, clams, mussels) that are sold or served shall be maintained by retaining shellstock tags or labels for 90 calendar days from the date when the last shellstock from the container is sold or served using one of the following methods: 1) an approved record keeping system that keeps the tags or labels in chronological order correlated to the date when the last shellstock from a container are sold or served, 2) preserving source identification by using a record keeping system, and 3) ensuring that shellstock from one tagged or labeled container are not commingled with shellstock from another container with different certification numbers, different harvest dates, or different growing areas as identified on the tag or label before being ordered by the consumer. EHS reviewed proper disposition of shell stock tags, and their public health significance with CFM and employees present. CFM agreed to oversee shell stock tags in the future.

    Observation: Raw animal food stored over ready-to-eat food in the refrigeration unit. Raw chicken in plastic wrap, and raw calamari in a tub were observed stored above several covered containers of cooked pasta in the one door prep top refrigerator.
    Correction: Raw foods like poultry, beef, pork, seafood, and eggs shall be stored properly inside refrigerators and freezers to prevent cross contamination. Raw foods shall be stored on shelving units BELOW or SEPARATED from all cooked foods, commercially processed foods, washed produce, leftover foods, etc. Employee immediately relocated foods for safe storage.
  • Critical: Cold Holding of Potentially Hazardous Food at 41°F or less (corrected on site) (repeated violation)
    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device: Lasagna (42 F), ham (43 F), Meat sauce (43 F) in the walk in refrigerator.
    Correction: Potentially hazardous foods (time/temperature conrol for safety food) shall be held cold at a temperature of 41°F or below. It is suggested that the door and gasket of the walk in refrigerator be repaired or replaced to form a tight seal. Unit was maintained closed and an ambient air temperature of 39 was observed at the end of the inspection.
  • Critical: Certified Food Manager/Presence Required (corrected on site)
    Observation: There is no Certified Food Manager present at the beginning of the inspection.
    Correction: It shall be unlawful to operate a food establishment unless it is under the immediate control of a certified food manager. It is highly suggested that you have more than one employee with the food manager's license. ORS Interactive, Inc. (see handout provided) issues the required photo identification card with proof of successful completion of a certified food manager's exam. Failure to have a certified food manager on site during ALL hours of operation including food preparation, food service, and cleaning/sanitizing of equipment/utensils will result in closure of the establishment. CFM arrived within 10 minutes of beginning of inspection. EHS provided handout to facilitate other employees to become CFMs.

A substantial improvement in control of food safety risk factors and general cleanliness / maintenance of the facility was observed. All critical violations on last routine inspection were observed corrected. CFM/Owner is making obvious effort to correct good retail practice violations as well.
No new shellstock was purchased between the last routine inspection and the follow-up inspection. EHS reviewed procedures for shellstock records with CFM.

Active managerial controls help to ensure food safety. Ensure that all employees are trained to safely store, prepare, and handle food and equipment. Maintain adequate supplies of materials required for safe food preparation at all times. Food managers should proactively monitor processes to verify food is safe at all times.
EHS provided handwashing reminder signage, preventing cross contamination posters, employee illness reporting agreements, and a food thermometer to assist the CFM in controlling food safety.
Correct all critical violations listed herein before the follow up inspection scheduled on or about 4 March 2015. Refer to the corrective actions statements in the report for information to correct violative conditions.

  • Duties / Monitor Sanitizing Practices and Procedures
    Observation: Materials to make sanitizing solution were not available in the facilitiy during the inspection.
    Correction: The Person in Charge or certified food manager shall train his/her employees to properly sanitize all equipment, utensils, and surfaces after being cleaned using either an approved sanitizer at the adequate concentration or heat sanitization at the proper temperature to destroy pathogenic bacteria. ENSURE PROPER SUPPLIES TO MAINTAIN FOOD SAFETY ARE STOCKED AT ALL TIMES. ENSURE CONCENTRATION OF SANITIZING CHEMICALS ARE MONITORED BEFORE USE.
  • Duties / Train Employees in Food Safety
    Observation: Employees are not properly trained in food safety as it relates to their assigned duties.
    Correction: The Person in Charge or certified food manager shall train all his/her employees in food safety as it relates to their assigned duties. TRAINING SHOULD INCLUDE SAFE FOOD STORAGE AND SANITIZATION OF FOOD CONATACT SURFACES.

    Observation: The CFM was unable to present evidence that employees were aware of thier responsibility to report illnesses from, symptoms of, and exposures to food-transmissable illnesses. CFM was unable to adequately answer questions about what symptoms and illnesses that employees must report.
    Correction: Employees must be aware of thier responsibility to report illnesses from, symptoms of, and exposures to food-transmissable illnesses. CFM WAS THE ONLY EMPLOYEE PRESENT DURING THE INSPECTION. CFM COULD NOT PROVIDE EVIDENCE THAT OTHER EMPLOYEES WERE TRAINED IN PROPER HEALTH REPORTING. EHS PROVIDED EMPLOYEE HEALTH POLICY DOCUMENTATION IN SPANISH. CFM AGREED TO TRAIN STAFF AND HAVE EACH EMPLOYEE SIGN THE EMPLOYEE ILLNESS REPORTING AGREEMENT (FORM #2).

    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during preparation from cooked foods, ready-to-eat foods, washed produce, etc. Do NOT prepare raw foods on the same work table as ready to eat foods. REARRANGE ALL FOODS FOR SAFE STORAGE IN ALL AREAS OF THE FACILITIES. INSTRUCT ALL EMPLOYEES IN SAFE FOOD STORAGE. EHS PROVIDED PREVENTING CROSS CONTAMINATION POSTERS FOR EACH REFVRIGERATION UNIT IN ENGLISH AND SPANISH.

    Correction: During pauses in food preparation or dispensing, food utensils shall be stored in one of the following manners: 1) in the food with their handles above the top of the food and the container, 2) in food that is not potentially hazardous (time/temperature control for safe food) with their handles above the top of the food within containers or equipment that can be closed, 3) on a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food contact surface of the food preparation table or cooking equipment are cleaned and sanitized, 4) in running water of sufficient velocity to flush particulates to the drain, 5) in a clean, protected location if the utensils are used only with a food that is NOT potentially hazardous (time/temperature control for safe food), or 6) in a container of water if the water is maintained at a temperature of at least 135°F and the container is cleaned frequently.

    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below. CFM WAS ADVISED MULTIPLE (3+) TIMES BY EHS TO DISCARD FOOD OR RELOCATE FOOD TO A PROPERLY FUNCTIONING COLD HOLDING UNIT. FOODS WERE NOT DISCARDED OR RELOCATED DURING THE INSPECTION. UNIT WAS ADJUSTED DURING INSPECTION BUT HAD NOT REACHED PROPER COLD HOLDING TEMPERATURE BY END OF INSPECTION. EHS PROVIDED FOOD THERMOMETER TO FACILITATE MONITORING FOOD TEMPERATURES IN THE PREP TOP. ENSURE THERMOMETER IS WASHED, RINSED, AND SANITIZED EVERY FOUR HOURS.
  • Critical: Date Marking of Refrigerated, Ready-to-Eat PHF (TCS Food) (repeated violation)
    Observation: The following refrigerated, ready-to-eat, potentially hazardous food that is prepared on site is not used or discarded within 24 hours of preparation and was not observed to be date marked: Lasagna (4 days old), pasta sauce (4 days old).
    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees. ENSURE ALL POTENTIALLY HAZARDOUS FOODS PREPARED ON SITE OR COMERCIALLY PROCESSED AND OPENED ARE CLEARLY DATE MARKED. TRAIN ALL EMPLOYEES IN PROPER DATE MARKING, AND MONITOR DATE MARKING OF FOODS.

UNIT WAS ADJUSTED TO DEFROST, AND WAS NOT RE AJUSTED TO MAINTAIN FOODS AT PROPER TEMPERATURE. MONITOR UNIT COOLING SETTINGS AND FOOD STORAGE TEMPERATURES FREQUENTLY.

    Correction: Surfaces of utensils and equipment contacting food that is NOT potentially hazardous (time/temperature control for safety food) such as ice bins, beverage dispensing nozzles, and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment at a frequency specified by the manufacturer or at a frequency necessary to preclude accumulation of soil or mold. DRAIN AND THOROUGHLY CLEAN AND SANITIZE THE ICE MACHINE INTERIOR.

    Observation: An air gap between the water supply outlet of the hanging sprayer and the flood rim level of the dishwash prep sink is not observed.
    Correction: An air gap between the water supply inlet and the flood level rim of the plumbing fixture, equipment, or nonfood equipment shall be at least twice the diameter of the water supply inlet and may not be less than one inch. REPAIR SPRAYER SO THAT IT HANGS NO LESS THAN 1" ABOVE THE FLOOD RIM LEVEL OF THE SINK.

Today’s inspection was to conduct a risk factor assessment. Thank you for accompanying me through the inspection as your participation allows me to clarify information and identify areas where your processes may need further attention or assessment.
EHS provided additional training and written instructions on:
-How to make chlorine sanitizer wet wiping bucket
-Cross contamination and food storage.
*Please avoid repeated violations.
**Please wash, rinse and sanitize the ice maker. Please be sure to make sanitizer solution (50 to less than 200ppm chlorine sanitizer solution) in correct concentration and fully dry before allowing ice making.

  • Critical: Food Protection from Contamination / Separate Raw from RTE (corrected on site) (repeated violation)
    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: raw veal over cooked squid in 2dr prep cooler, raw egg over salad in walk-in cooler, raw chicken over cooked pasta in 1dr prep cooler.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc.
  • Critical: Food Protection from Contamination / Separate Types of Raw Animal Foods (corrected on site)
    Observation: Different types of raw animal foods stored in such a manner that may cause cross contamination as follows: raw chicken over raw mussels, raw pork over raw fish in 2dr prep cooler at cookline.
    Correction: Raw animal foods shall be sorted by their "type" and cooking temperatures while in storage inside a refrigerator or freezer. For example, if using ONE shelving unit for storage of ONLY raw foods, the foods shall be sorted in this manner: 1) raw poultry (chicken, turkey, or duck) shall be stored on the BOTTOM shelf (165°F cook temperature), 2) raw ground beef and ground pork shall be stored on the shelf above poultry (155°F cook temperature), and 3) raw pork (chops, ribs), seafood, and shell eggs shall be stored on the top shelf above beef (145°F cook temperature).
  • Clean Ice Bins, Beverage Dispenser Nozzles, Etc. per Manufacturer Specs.
    Observation: Surfaces of ice maker's enclosed components of equipment are not being cleaned as required. Observed mold.
    Correction: Surfaces of utensils and equipment contacting food that is NOT potentially hazardous (time/temperature control for safety food) such as ice bins, beverage dispensing nozzles, and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment at a frequency specified by the manufacturer or at a frequency necessary to preclude accumulation of soil or mold. Discussed need for routine wash, rinse, and sanitize.

    Observation: Observed that poisonous and toxic materials are not properly stored to prevent the contamination of food, equipment, utensils, linens or single service items: over-the-counter medicine and air freshener on food shelf.
    Correction: All poisonous and toxic materials shall be stored to prevent contamination of food, equipment, utensils, linens, and single service items by separating the poisonous and toxic materials by spacing or partitioning. Relocated.

    Observation: A food employee failed to wash his or her hands after handling raw chicken.
    Correction: ALL food employees shall wash their hands OFTEN especially after handling trash, using the restroom, handling raw meats, handling soiled equipment and utensils, BEFORE putting on clean gloves, etc. Proper handwashing frequencies will aid in the reduction of foodborne illness.
  • Critical: Molluscan Shellstock/Maintaining ID/Tags Attached until Container Emptied (corrected on site) (repeated violation)
    Observation: Tags missing from the molluscan shellfish containers: clam and mussel.
    Correction: Shellstock tags shall remain attached to the container in which the shellstock are received until the container is empty. After all shellstock is used, please note date of last sold and keep tags for 90days.
  • Critical: No Bare Hand Contact with RTE Foods (corrected on site) (repeated violation)
    Observation: A food employee was observed handling the following ready-to-eat food using their bare hands: salad.
    Correction: Except when washing fruits and vegetables, food employees may not contact ready-to-eat foods using their bare hands. Employees shall use suitable utensils such as deli tissue, spatulas, tongs, or clean disposable gloves to handle all ready-to-eat foods. Salad was discarded.

    Observation: Raw animal food holding in a manner that may cause cross contamination of ready-to-eat food as follows: raw bacon over parmesan cheese, raw squid over parmesan cheese in 2dr prep cooler.
    Correction: Food shall be protected from cross contamination by separating raw animal foods like poultry, beef, pork, seafood, and eggs during holding from ALL other foods such as cooked foods, ready-to-eat foods, washed produce, etc.
  • Critical: Consumer Advisory Required for Raw or Undercooked Animal Food (repeated violation)
    Observation: A review of the menu with the foodservice operator indicates that there is no consumer advisory for the following food item(s) that may be served raw and/or undercooked: cooked to serve steak in dinner menu and hamburger in lunch menu.
    Correction: If an animal food such as beef, eggs, fish, lamb, milk, pork, poultry, or shellfish is served or sold raw or undercooked the permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. Manager will hand correct.
  • Critical: Chlorine Sanitizer Solution Concentration based on pH and Water Temp (corrected on site)
    Observation: When tested, the chlorine-based sanitizing solution was observed to be at a concentration less than what is required for effective sanitization of food-contact surfaces of equipment and utensils. Observed the sanitizing solution in the wet wiping towel sanitizer bucket with a concentration of above 200 ppm total chlorine.
    Correction: A chlorine-based sanitizing solution shall have a minimum concentration of at least 50 to100 ppm total chlorine when tested using the appropriate test kit. EHS demonstrated how to make chlorine sanitizing solution in smaller portion.
  • Critical: Food-Contact Surfaces Cleaned Any Time after Contamination (corrected on site) (repeated violation)
    Observation: Equipment food-contact surfaces/utensils were not observed cleaned before any possible contamination: two cutting boards used to prep raw chicken before preping ready to eat food.
    Correction: Equipment food-contact surfaces and utensils shall be cleaned at any time during the operation when contamination may have occurred. Sanitized cutting boards and prep table.
  • Certified Food Manager/Certificate Process
    Observation: The person in charge (PIC) has a valid certificate of successful completion of a Certified Food Manager (CFM) exam but does not possess the CFM card issued by ORS Interactive, Inc.
    Correction: Food managers who possess a valid certificate of passing a food safety exam shall obtain the photo identification card from ORS Interactive, Inc. (see handout provided) within 10 business days. A copy of the photo identification card can be faxed to the food safety section at (703) 385-9568. Failure to provide a copy of the photo identification card will result in further enforcement action.

    Observation: The following food item(s) were observed cold holding at improper temperatures using a calibrated food temperature measuring device: Provolone cheese (46F), deli ham (48F) on prep top.
    Correction: Potentially hazardous foods (time/temperature control for safety food) shall be held cold at a temperature of 41°F or below unless the permit holder is using "time as public health control" as specified under 3-501.19 to limit bacteria growth. Both moved to lower cabinet.

    Observation: A review of the menu with the foodservice operator indicates that there is no consumer advisory for the following food item(s) that may be served raw and/or undercooked: cooked to serve steak.
    Correction: If an animal food such as beef, eggs, fish, lamb, milk, pork, poultry, or shellfish is served or sold raw or undercooked the permit holder shall inform consumers of the significantly increased risk of consuming such foods by way of a disclosure and reminder using brochures, deli case or menu advisories, label statements, table tents, placards, or other effective written means. Manager will take it off the menu in 2-3 weeks and new menu on order will not have steak on the menu, so no follow-up is required.

    Observation: Equipment food-contact surfaces/utensils were not observed cleaned after any possible contamination. Observed employee putting raw shrimp over cutting board on prep cooler but did not clean and sanitze afterwards.
    Correction: Equipment food-contact surfaces and utensils shall be cleaned at any time during the operation when contamination may have occurred.
  • Handwashing Sink / Mix Valve or Combination Faucet , Water at 100°F
    Observation: Water from the handwashing sink in the kitchen was measured at a temperature less than 100°F. There is no hot water at this hand sink.
    Correction: A handwashing sink shall be equipped to provide water at a temperature of at least 100°F through a mixing valve or combination faucet.

    Correction: Refrigerated, ready-to-eat, potentially hazardous foods that are prepared on site and kept for more than 24 hours cannot have a shelf-life of more than 7 days, including the day of preparation. These food items must be marked with either the "consume-by" date and/or "preparation" date, color-coded labels, or another marking system/method that effectively indicates shelf-life that is clearly understood and properly used by the employees.
