How is this different from selling fake Rolex watches? You’ll be jailed for that.
The phrase you're looking for is "likelihood of confusion". Fake Rolex watches may confuse the customer into thinking they're buying an actual Rolex product. But if someone were to put "Rolex can't keep time" on a t-shirt, there is no confusion.
