Some legal cases are difficult to decide, this is not one of them. Trump is a public figure and therefore cannot prevail in a defamation lawsuit unless there is proof that de Blasio acted with reckless disregard for the truth. That's nearly impossible to prove and the burden of proof rests upon Trump.

The Copyright and Trademark laws require the letters TM to be shown after the claimed trademark. If it is not present, it is public use. Also, Trump would have had to file that slogan as a trademark prior.

So, all you Trump fans, you can pour cold water on your junk now.

Well, I thought we already established that Trump believes in obeying the law so why be surprised. A copyright violation is a big deal: Copyright Law in the United States Just because we have people that believe they are above the laws in the US, it doesn't mean that they are.
