So they want to milk some poor sap for all the free labor they can, and then when he starts getting antsy they'll say, sorry, we're not hiring at this time.

There are several restaurants around here that do this, they try you out for half a shift or full shift. They're pretty desirable places to work and cultural fit is critical there. It seems to work out fine for them.

If you're going to be performing job duties for those 4 hours and said employer will be profiting from the job duties you complete, then that's illegal and the employer can't do that...

And there also are several places that pay employees under the table to avoid paying taxes.
Even if both parties are fine with the arrangement, that still doesn't make the arrangement legal.

It apparently is here. It was looked into after a Boston Globe story on it and it was found to be fine. It was, I understand, considered a form of job shadowing.
Lots of people want to work at this place, so if you don't like the arrangement, don't do it. There are ten more that want the spot.
Heck, I volunteered for 6 months at an org just to make connections / try to get in the door after undergrad with the hopes of scoring an interview. Was that illegal? Nope. What is 4 hours?
