Cox typically does maintenance on their fibre infrastructure around 3am. Any other time smells of outage.

I like to go to sleep streaming with some selected streaming music. Usually, sometimes after midnight, it stops and check the phone - no dial tone. Call COX on my mobile and get the "we're working on it" recording.

Saturday afternoon the Cox TV was not working all afternoon. Not sure when it came back on. We gave up. Dish is so much better for TV.

Steinberg and the CCSD paid dearly to dig up this valley and put in the first fiber ring. They put in the infrastructure. Cox owns the market because they own that infrastructure.

There are currently 14 rings... However, in reality this infrastructure when plotted on a map zig-zags all over the valley.

At any rate... I believe the leasing of this infrastructure to 3rd parties is a Federal requirement.

Source? I am not against it but I do not believe it. It could get really interesting if Cox had to lease. But note the last stretch is coax not fiber.

Federal Communications Act, 47 U.S.C. § 151 et seq. as amended by the Telecommunications Act of 1996

The FCA places wire services into three categories with distinct regulatory implications: cable services, telecommunications services, and information services. See Bova, 2001 WL 1654708, at *1. Traditionally, the FCA requires carriers of "telecommunications services" to be treated as "common carriers" subject to the obligations of §§ 201(a) and 202(a). Pursuant to the Act, common carriers are charged with the duties of nondiscrimination and interconnection, which "mandate a network architecture that prioritizes consumer choice, demonstrated by vigorous competition among telecommunications carriers." Portland, 216 F.3d at 879. Treatment as a common carrier would therefore prohibit CoxCom from maintaining an exclusive relationship with Excite@Home and force it to negotiate with any ISP, like Verizon Online, willing to provide a connection to the Internet.

The FCC reclassified fixed and wireless broadband access services as common carrier telecommunications services under Title II of the 1934 Communications Act in 2015.

Cox is currently fighting this designation(along with other carriers), but as it stands now, they are considered a common carrier by the FCC, and would therefore be required to lease their infrastructure to any legitimate interest that asks.

FWIW, Cox is already leasing to several organization in the valley, so I think it will be tough for them to argue that Title II does not apply.

I suspect that Cox & Verizon will lose the current case... as it was already determined long ago that Title II applies to the providers' copper infrastructure(but NOT cable _television_), and this is why anyone can open a DSL ISP and purchase the dry loops from Centurylink for resale.

As it stands now, if Cox were to refuse to provide access, they would fall under the jurisdiction of the FCC and could (probably would) be penalized, and then forced to provide access.
