Don't quite understand how you can make that determination when there has been no statement to that effect from the PD.
And before you go off on a tangent, let me tell you that a struggle for a cop's weapon is a life and death struggle. According to reports, the second officer shot the bad guy in an effort to stop him from getting control of the first officer's weapon -- a move that might have meant death or serious injury to both cops.
Before this gets way out of hand, perhaps you better wait for more information before jumping to conclusions.

that being said, the perp was allegedly going for the officers gun, correct? how do we know that? do we know if the perp was trying to get out of the car while the officer prevented him in doing so and the perps hands may have reached out, not intentionally going for the officers weapon, but any direction in that matter, while exiting the vehicle? the officer was probably prepared for the unexpected, with his hand on the gun, or going for it and the officer fired off his own gun, shooting himself? also, how far was the perp from either officer when he was killed? was he still in the midst of the scuffle while the officer shot at the perp, while the wounded officer was in direct body contact, possibly endangering his partners safety even furthur? or was perp shot in the back while running away?

I also understand that cops dont live by the movies where theres always a "happy ending" where the criminal is always apprehended and bought to justice. if its a matter a cop surviving, "shoot to kill" is the answer.
